Terms of Service – SOFTCOVE

These Terms of Service (“Terms”) govern your access to and use of the SOFTCOVE website, products, and services. By placing an order or using our site, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By accessing the SOFTCOVE website at softcove.shop or any associated subdomains, you confirm that you are at least 18 years of age or have obtained parental or guardian consent. These Terms constitute a legally binding agreement between you and SOFTCOVE, LLC. We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use after changes constitutes acceptance of the new Terms.
2. Account Registration
To purchase products or access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information. SOFTCOVE reserves the right to suspend or terminate accounts if we suspect any violation of these Terms or fraudulent activity.
3. Orders and Product Availability
All orders placed through SOFTCOVE are subject to acceptance and availability. We reserve the right to limit order quantities or refuse any order. Once an order is placed, we will send a confirmation email. If a product is out of stock, we will notify you and issue a full refund for that item. We do not guarantee that product descriptions, colors, or images displayed on our site are 100% accurate, as monitor settings may vary.
4. Pricing and Payment
All prices are listed in U.S. Dollars and exclude applicable sales tax (calculated at checkout). Payment must be made via accepted methods (credit/debit card, PayPal, etc.). By providing payment information, you represent that you are authorized to use the method. SOFTCOVE uses secure third-party payment processors; we do not store your full payment details. Prices are subject to change without notice, but any price changes will not affect orders already confirmed.
5. Shipping and Delivery
We ship to addresses within the United States and select international destinations. Shipping times and carriers are provided at checkout. SOFTCOVE is not responsible for delays caused by carriers or customs. Risk of loss and title for items pass to you upon delivery to the carrier. Any shipping insurance can be requested prior to shipment. International customers are responsible for all customs duties, taxes, and import fees.
6. Returns, Exchanges, and Refunds
We want you to love your SOFTCOVE purchase. If you are not completely satisfied, you may return most unused items within 30 calendar days of delivery for a full refund to the original payment method. Items must be in original condition and packaging. Customers are responsible for return shipping costs unless the item is defective or incorrect. 7. Intellectual Property
All content on the SOFTCOVE website—including text, graphics, logos, images, product designs, and software—is the property of SOFTCOVE, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. The name “SOFTCOVE” and associated logos are trademarks of SOFTCOVE, LLC.
8. Prohibited Uses
You agree not to use our website for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to: hacking, data mining, transmitting viruses, posting false reviews, or attempting to interfere with site security. Violations may result in immediate termination of your account and legal action.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOFTCOVE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS OR WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless SOFTCOVE, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising out of your breach of these Terms or your misuse of our products or website.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or your use of SOFTCOVE shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to personal jurisdiction in those courts.

Your use of our website is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using our services, you consent to such data practices.
